It is well known that all medical treatment can be refused provided that at the time of the decision you are physically and mentally capable of so deciding.

We are also all aware of cases where patients have been kept alive, sometimes for years, though of no benefit to the patient themselves simply because their family cannot make the heartbreaking decision to let them go.

The thought of being trapped in a body, kept alive by machines and unable to communicate is probably one of the most terrifying scenarios that a human being could face.

An Advance Directive can go a long way in ensuring that this, thankfully rare, but nevertheless nightmarish situation does not arise.

Put simply you can direct, in advance, that under certain specific circumstances and providing strict criteria are adhered to that life prolonging treatment will not be forced on you.

In this way you have removed the almost impossible burden from your family and friends and made the decision yourself.

Whilst palliative care will always be given it should be noted that you can only 'opt-out' of treatment and cannot demand to be treated or insist that certain types of treatment be administered.

Whilst your 'opt-out' is normally legally binding it can be disregarded if emergency life-saving treatment is being given or were you being treated under the Mental Health Act 1983 for 'mental disorder'.

In addition your directions can be overruled by court order if the court finds that to be in your or the public interest.

An Advance Directive is also no justification for the offence of assisted suicide.
